Insightful Acceptable Use Policy

This Policy applies to all Clients and any users of our Service. Your use of our Service confirms that you accept the terms of this Acceptable Use Policy alongside our Terms of Service and Privacy Policy.


AUP. This Acceptable Use Policy (the “AUP”) governs Customer’s, Customer Agent’s and User’s access to or use of the Service. This AUP provides guidance on what constitutes misuse of the Service.
AUP violations. In addition to any remedies available to Insightful pursuant to the Agreement, a violation of this AUP by Customer, Customer Agent or User may be deemed by Insightful to be a material breach of the Agreement and Insightful may choose to suspend or terminate Customer’s access to the Service.
Prohibited Uses.
Customer, any Customer Agent and any User shall be prohibited from using the Service:
- for any unlawful purpose;
- to conduct any unlawful acts or solicit others to perform or participate in any unlawful acts;
- to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
- to use the Service for any purpose or in any manner that infringes upon or violates the rights, including but not limited to intellectual property rights, of Insightful or any third party;
- to harass, abuse, insult, harm, defame, slander, stalk, threaten, disparage, intimidate, discriminate in any way, including, but not limited to, discrimination based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability, or otherwise violate the legal rights (such as of privacy or publicity) of any other users of the Service or Insightful’s employees, affiliates, or partners or the employees, affiliates, or partners of any other platform or integration with which Insightful does business;
- to submit false or misleading information;
- to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;
- for any obscene or immoral purpose;
- to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet;
- to interfere with or carry out any activity that threatens the performance, security, or proper functioning of the Service;
- to attempt to compromise the system integrity or security or decipher any transmissions to or from the servers running the Service;
- to attempt to access unauthorized accounts or to collect or track the personal information of others;
- to abuse any trial offerings with respect to the Service;
- to abuse any rebate offerings with respect to the Service;
- in any way that violates the policies of any other platform or integration with which Insightful does business;
- to copy, distribute, or disclose any part of the Service in any medium other than as allowed by the Service and this Agreement;
- to use any automated system (other than any functionalities of the Service), including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Service;
- to transmit spam, chain letters, or other unsolicited email or attempt to phish, pharm, pretext, spider, crawl, or scrape;
- to impersonate another person or otherwise misrepresent Customer’s affiliation with a person or entity, conduct fraud, hide, or attempt to hide Customer’s identity;
- to attempt to decipher, decompile, disassemble, or reverse engineer any of the software or algorithms used to provide the Service;
- in a manner that violates any technical documentation, usage guidelines, or parameters;
- to make automated decisions that may have a detrimental impact on individual rights without appropriate human supervision; or
- to encourage or enable any other individual to do any of the foregoing.
Prohibited Actions
Customer, any Customer Agent and any User shall not be permitted to:
- install the Service on any computer or device Customer does not own without prior permission of the owner of such computer or device.
- install the Service on a public computer or device which Customer does not own, or have full legal, administrative rights to modify.
- monitor device usage for the purpose of learning personal information about the device user without their consent.
- install the Service with the intention to stalk or spy on a device user without their consent.
- use the Service for service bureau or time-sharing purposes or in any other way allow Third Parties to exploit the Service, except as specifically authorized by this Agreement;
- provide Service passwords or other log-in information to any Third Party, except as specifically authorized by this Agreement or via a third party integration provided as part of the Service;
- share non-public Service features or content with any Third Party; or
- access the Service in order to build a competitive product or service, to build a product using similar ideas, features, functions or graphics of the Service, or to copy any ideas, features, functions or graphics of the Service.
Modifications
Insightful reserves the right to update this AUP from time to time. Customer’s continued use of the Service following such update(s) will constitute acceptance of the changes.
